Federal Judge Orders Freedom of Kilmar Abrego Garcia from Immigration Custody
A court has ordered the prompt release of Kilmar Abrego Garcia from detention by ICE, finding his continued detainment is without legal authority.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her order.
The situation stems from a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an mistake. After his repatriation to the United States to face human smuggling charges, he was detained in immigration detention.
In her decision, the judge pointed out that the government lacks a valid deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."

The legal challenge center on disputed claims. While the former administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently disputes this allegation.
